TERMS & CONDITIONS OF THE SALE OF GOODS
THE CONTRACT BETWEEN US
These Terms & Conditions of the Sale of Goods apply to all transactions between us, and any sale of goods by us to you. Please read them carefully. Shoko Press reserves the right to change these Terms & Conditions of the Sale of Goods from time to time by updating this page. Orders placed by you are an offer to purchase and a contract is only formally created once your offer to purchase is accepted by us. You will receive an email confirmation from us once your order has been accepted. These terms and conditions, together with the prices displayed on our website, delivery details, contact details and any document expressly referred to in these Terms and Conditions of the Sale of Goods, set out the whole of our agreement relating to the sale of goods by us to you. These Terms and Conditions of the Sale of Goods do not affect your statutory rights.
PRODUCT INFORMATION AND AVAILABILITY
Each product purchased is sold subject to its product description. The information, including all drawings, images, descriptive material, specifications and advertising on our website are for the sole purpose of giving an approximate description of the goods in order to assist your purchasing decision. All goods advertised are strictly subject to availability. We aim to keep the website as up to date as possible, however all information, including product descriptions, appearing on this website at any given time may not always reflect the position at the time you place an order. Every effort is made to ensure that all the information on our website is correct at the time of viewing. Shoko Press shall not be liable for any direct or indirect or consequential loss arising from any inaccurate image or description.
PRICES AND CANCELLATION BY US
The price payable for goods will be stipulated on our website at the time you place your order. The total cost of your order is the price of the goods ordered plus delivery. The prices shown are in UK sterling (GBP) and are exclusive of VAT. Any delivery charges are extra. All orders are subject to stock availability. We reserve the right to cancel your order if: - we have insufficient stock to deliver the goods you have ordered; or - we do not deliver to your area or cannot find a cost effective postal carrier to do so; or - one or more of the goods you ordered was listed at an incorrect price due to a typographical error; or - your payment is not authorised or is refused. If we discover an error relating to your order, we will contact you as soon as possible to advise you of the error and confirm that you still wish to proceed. If we do cancel your order, we will notify you by e-mail and we will re-credit to your account any sum debited by us from your credit card within 30 days of your order. We are not obliged to offer any additional compensation for inconvenience or disappointment suffered.
International Customers
For addresses outside the UK and Ireland. The final price for overseas customers will be calculated in accordance with the applicable exchange rate on the day your debit/credit card company processes the transaction. International orders may be subject to the relevant import taxes, customs duties and fees of the destination country, which is the responsibility of the purchaser. Shoko Press is not liable for any such taxes, duties or fees.
CANCELLATION BY YOU
You may cancel your order before the end of the 5th working day after you place your order, even if you have then already received the goods. You do not need to give us reason for cancelling your order nor will you have to pay any penalty. You may cancel your order by returning the goods you have ordered within 14 days after they are delivered. The only circumstance in which you cannot cancel your order is where you have taken the goods you have ordered (or the ones in relation to which you want to cancel) out of the sealed package in which they were delivered. To cancel your order you must notify us by writing to the following email orders@shokopress.com. If you have received the goods before you cancel your order then, unless you have lost your right to cancel because you have taken the goods out of their sealed package, you must send them back to the address that will be supplied at your own cost and risk. If you cancel your order but we have already processed the goods for delivery you must not unpack the goods when you receive them and you must send the goods back to us at our supplied contact address at your own cost and risk as soon as possible. Once you have notified us that you are cancelling your order, any sum debited by us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order provided that the goods in question are returned by you and received by us in the condition they were in when delivered to you.
DELIVERY OF GOODS TO YOU
We will deliver the goods you have ordered to the address you provide us with for delivery at the time you make your order. We will make every effort to deliver your goods within 28 days but delay in delivery is sometimes outside of our control. If your delivery address is outside of the UK and Ireland, Europe or North America delivery times may take longer than 28 days. Any dates we give you for delivery are approximate only and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay in delivering the goods to you. You will become the owner of the goods you have ordered once they have been delivered to your specified delivery address and your payment has been authorized and cleared by the credit card company. Once the goods have been delivered we no longer have any responsibility for any loss or damage to the goods. Digital goods will be available for download soon after payment, unless stated otherwise, and no physical product will be shipped.
RETURNS AND EXCHANGES
Shoko Press will not accept the return of goods unless the goods we deliver are not what you ordered, or are damaged or defective, or the delivery is of an incorrect quantity. In those instances our only obligation will be: - to make good any shortage; or - to replace or repair any goods that are damaged or defective; or - to refund to you the amount paid by you for the goods in question. Our maximum liability to you arising from any product you purchase from us shall be the price you paid for the product. When returning goods we recommend using recorded post and retaining Proof of Postage as we do not accept responsibility for items lost, delayed or stolen in transit, and to the extent permitted by law, we shall not be liable to you for any indirect or consequential loss or damage that is caused by any event or circumstance beyond our reasonable control, which shall include, but not be limited to, acts of God, civil commotion, riots, flood, drought, fire, and legislation.
Digital Goods
Due to the unphysical nature of digital items they cannot be returned or exchanged. If you have any problems with your digital product please contact us at email orders@shokopress.com and we will endeavour to do our best to sort out the issue. Our cancellation policy does not apply to digital goods as download links are sent instantly.
LATE OR LOST ITEMS
Items to be delivered within the UK and Ireland will be sent primarily by Royal Mail. Items sent internationally may either be sent through the Royal Mail International Standard or Economy service or another suitable postal carrier. Once your items are placed by us with the relevant postal carrier, we are no longer liable for those items and in the event that they are late, lost or stolen, it is with that relevant postal carrier that any liability for late, lost or stolen items will lie. Shoko Press will however, endeavour to make all reasonable efforts to assist you in tracking down your items so that they are delivered to you. If you do not receive goods ordered by you within 30 days of the date on which you ordered them, or up to 40 days if your delivery address is outside of the UK and Ireland, Europe or North America we shall have no liability to you unless you notify us in writing at our supplied contact address of the problem within 40 days, or 60 days if your delivery address is outside of the UK and Ireland, Europe or North America of the date on which you ordered the goods.
